Hey divas! This Terms of Service (TOS) agreement applies to your access and use of the websites, mobile apps, and products - collectively known as the Services - provided by PDX Divas.

Age Requirements
You must be a legal adult (18+) in order to use the Services. If you are not an adult, you are expressly prohibited from creating an account.
Your Use of the Services
PDX Divas grants you a personal, non-transferable, non-exclusive, revocable, limited license to use and access the Services solely as permitted by these Terms. PDX Divas reserves all rights not expressly granted to you by these Terms.

Your license to use the Services does not include the right to collect/harvest data of any other users of the Services in order to build a similar or or competing website, directory, product, database, or service.

We reserve the right to modify, suspend, or discontinue the Services (in whole or in part) at any time, with or without notice to you. Any future release, update, addition, or modification to the functionality of the Services will be subject to these Terms, which may be updated on occasion. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Services or any part thereof.
Your Diva ID and Security
To use certain features of the Services, you may be required to create a Diva ID - an Account - and provide us with certain personal information in association with an email address and password.

It is your responsibility to ensure that your Diva ID remains secure. We recommend that you use a unique password for your Diva ID, and that any booking email you include on your Diva Profile be different from the one you use to login to the Services.
Communications
We dislike spam just as much as the next person, however it may be necessary for us to communicate with you via email on occasion. We will NEVER intentionally spam you! By using the Services, you consent to communications via email when there are major platform updates. Additionally, if you have purchased any Event tickets using the Services, you consent to being contacted by Event Producers regarding major changes such as rescheduling or cancellations of Events.
AI
We are stong opponents to the use of GenAI (generative artificial intellegence) and will never use your personal account or profile data to automatically generate images, videos, or any other audio/visual media that could be mistaken as user generated content.
Privacy
At PDX Divas, we understand that personal information privacy is important, so we want you to understand how we use the personal information associated with your Diva ID.

Your legal name, login email address, phone number, date of birth, and zip code are not published on our website or sold to third-parties. Only the information that is part of a Diva Profile application is made accessible to other users of the Services unless they are a verified Event Producer. This includes your stage name, username, booking email, biography, photograph, skills, video links, social media links, and pronouns. For contact and verification reasons, Event Producers may be granted restricted access to your personal contact information and legal name.

We collect information on actions you take when using the Services. This includes your interactions with other users profiles and with content, such as viewing booking information, voting, blocking, and reporting.

Information we collect automatically may include the following: your IP address, browser user agent string, operating system, referral URLs, devices information, device settings, pages visited, links clicked, the requested URL, and search terms.
Affiliate and Social Media Links
We do not display any advertisements on our website that are hosted by third-party ad services. However, we may include affiliate links to third-party services and products and social media platforms. While these third-parties do not have direct access to your account information, they may be able to determine the referral URL of the affiliate or social media link. When used, affiliate links support the continued operation of the Services.
Event Producer Responsibilities
All Event Producers must be verified by the Services prior to posting Events or selling tickets. By posting an Event (and related media) using the Services, you agree that the event details may be promoted directly via the Services or on social media accounts run by the Services directly. When granted access, you agree to treat all private information about users of the Services with confidentiality.

You may not scrape, download, or use any of the private information for any reason besides to contact the attendees of your event when there is a major change—such as rescheduling or cancellation.

If a user of the Services contacts you directly regarding your Event or ticket sales, you must send them a documented response within 24 (twenty four) hours. Failure to do so may result in the suspension of your access to the Services and we may change the status of your Events to being cancelled if you fail to reply to us or your Event attendees within 72 (seventy-two) hours.
Ticket Sales
All event tickets sold through the Services grant access to the specific Event listed. The producer of the Event is reponsible for honoring the ticket and may turn away ticket holders at the discretion of Venue policies and Event safety policies set forth by the Event Producer (including but not limited to any age requirements, ID requirements, and health protocols such as testing/masking).

Refunds

Refunds are determined on a case-by-case basis for a given event, and are entirely up to the Event Producer to fund and facilitate. Ticket processing/platform fees are non-refundable by the Services, and are up to the Event Producer to refund with the total ticket price.

Event Cancellations or Rescheduling

If an event is cancelled or rescheduled by the Event Producer, they are soley responsible for notifying you of such changes and/or honoring any applicable refunds - including any ticket processing/platofmr fees that you may have incurred.

Ticket Processing & Platform Fees

We may charge fees for the processing of payments when purchasing tickets through the Services. Platform fees support the Services and are included in the advertised ticket price - specific platform and processing fees are shown in the price breakdown prior to checkout.

Ticket Transfers

All tickets sold through the Services are non-transferrable, and may only be redeemed by the ticket purchaser and their party. Event Producers may require a matching Photo ID or Diva ID to grant admission for any given ticket to their Event.

Limitation of Liability

As a platform providing the sale of tickets, we are not liable for the following:
Ticketing Disputes
If you encounter an issue with your ticket purchase or you have a concern regarding an Event, please contact the Event Producer directly, if they are unresponsive after 24hrs you may contact our support email address here. It is possible that you may see a duplicate pending charge on your debit or credit card statement prior to your payment being fully posted. Any chargeback filed through your financial institution may result in your Diva ID being deactivated, and you may be barred from attending future shows promoted via the Services, as well as shows for which you may have already purchased tickets.
How Your Information is Protected
We take measures to help protect your personal information. As an example, we use HTTPS to transmit information to and from your browser, and we use encryption methodologies to store all passwords. We also enforce access controls to limit which of our employees have access to non-public personal information.
Payment Processing
We presently use Stripe for processing sales of Event tickets and subscriptions to our Event Producer platform.
Changes to the TOS
We may update the Terms of Service on occasion. If we do, we will indicate a change by revising the date at the top of this document. If the changes, in our sole discretion, are material, we may also notify you by sending an email to the address associated with your account or by otherwise providing notice through our Services. We encourage you to review the TOS whenever you access or use our Services or otherwise interact with us to stay informed about these policies. By continuing to use our Services after updates to the TOS go into effect, you agree to and are bound by the revised policies.
